USPTO Proposed Changes to Trademark and Patent Fees

Trademark Fees:

On March 26, 2024, the USPTO released new proposed fees for trademark applications for the 2025 fiscal year. The proposed changes came with an increase in 19 existing fees, 12 new fees being introduced, and 6 fees being discontinued.


Proposed Filing Fees:

●       Base Application (paper): Increased from $750 per class to $850 per class

●       Base Application (Electronic): New fee of $350 per class

●       Base application filed with WIPO (§ 66(a)): New fee of $350 per class

●       Base application filed with WIPO (§ 66(a))(subsequent designation): New fee of $350 per class

○       Five of the current filing trademark fees were proposed to be discontinued.

Patent Fees:

On April 3, 2024, the USPTO proposed changes to patent fees for the 2025 fiscal year. The USPTO proposes to set or adjust 455 patent fees for undiscounted, small, and micro entities, including the introduction of 73 new fees.

Proposed Filing Fees:

●       36% increase for design patent application filing fees

●       9.375% increase for utility patent application filing fees

Issue Fees:

●       76% percent increase for design issue fees

●       Only a 5% increase for utility issue fees
